This Privacy Policy explains how Night Audit collects, uses, discloses, and protects information when you visit thenightaudit.com, request access, sign in, or receive Night Audit briefings and related messages.

Scope

This Privacy Policy applies to the Night Audit website, signup flows, email and SMS communications, briefing delivery, account management, product feedback channels, logs, analytics, and related support records.

It does not cover third-party websites, services, or platforms that Night Audit does not control, even if we link to them or use them to deliver messages.

Information We Collect

Depending on how you interact with Night Audit, we may collect information you provide directly, information collected automatically, information we generate or infer, and information from service providers that help us operate the service.

Information you provide may include name, company or organization, job title or function, role or persona, email address, phone number, selected topics or interests, vendor or brand watches, custom keywords, delivery channels, local timezone, preferred briefing time, selected delivery days, SMS opt-in status, STOP/HELP status, feedback, requests, and other messages you send us.

Information collected automatically may include IP address, device and browser information, approximate location derived from IP address, timestamps, referral and page-view data, login and authentication events, session information, cookies or similar technologies, delivery status, open/click activity, and other engagement signals.

We may also create or infer information such as briefing preferences, topic relevance, preferred delivery timing, engagement patterns, and product usage trends.

How We Use Information

We use information to create and manage accounts and access requests, review and approve beta access, verify identity, send magic-link login messages, send briefings and related SMS or email communications, personalize briefing content, maintain communication settings, process STOP/HELP requests, improve briefing quality, analyze delivery performance, provide support, detect fraud or abuse, comply with legal obligations, and enforce our terms.

AI and Personalization

Night Audit may use automated tools and AI-assisted workflows to help draft, rank, personalize, summarize, or improve briefings and product content.

Personalization may take into account your job title or function, role or persona, selected topics and watches, delivery preferences, and prior engagement with briefings and messages.

Halsey is the disclosed AI editor of record and may assist with drafting or editing briefing content. Night Audit is designed so that human review remains part of the process. We do not intend for personalization to make significant decisions about you without human oversight.

SMS and Email Communications

Night Audit is an SMS-first product. If you provide your phone number and separately opt in, we may send informational SMS messages, including beta approval or access messages, hospitality intelligence briefing alerts, reminder or follow-up messages, account-related service notices, and support responses.

By providing your phone number and opting in through the standalone SMS consent workflow, you authorize Night Audit and its service providers to send recurring informational SMS messages related to Night Audit. Reply STOP to stop receiving SMS messages. Reply HELP for help. Message and data rates may apply. Carrier fees may apply. Message frequency varies based on your preferences and account settings.

No mobile information or messaging consent is shared with third parties or affiliates for marketing or promotional purposes. This includes your mobile phone number, SMS opt-in data, and SMS consent status.

The current Night Audit SMS workflow does not collect marketing or promotional SMS consent, and promotional messages will not be sent under the informational SMS campaign.

Opting out of SMS may limit your ability to receive briefings by text, but it will not necessarily affect non-SMS account emails or other non-text communications. Some messages are operational, including account approval updates, login links, passwordless authentication messages, delivery confirmations, and service notices.

Night Audit uses passwordless authentication. We may send one-time magic links by email or SMS instead of using passwords.

To support this, we may collect and store your email address or phone number, token creation and expiration data, login timestamps, device or IP data associated with login attempts, and whether a login link was opened, used, or expired. We use short-lived, single-use tokens and secure sessions.

Delivery Logs, Conversation Logs, and Product Improvement

We keep delivery logs and conversation logs so we can operate the service, troubleshoot issues, and improve product performance. These logs may include the fact that a message was sent or received, message timestamps, delivery status, conversation history, support interactions, and feedback signals.

We may review SMS logs and delivery logs through automated tools and human review to identify product improvements, reliability issues, and abuse patterns. Where practical, we try to minimize, redact, or aggregate personal information in internal reports.

How We Share Information

We do not sell personal information and do not use personal information for third-party advertising.

We do not share mobile information, SMS opt-in data, or messaging consent with third parties or affiliates for marketing or promotional purposes.

We may share information with service providers that help us host, store, secure, analyze, send, or support the service; professional advisors such as lawyers, accountants, and insurers; law enforcement, regulators, or other parties when required by law or to protect rights and safety; a buyer or successor in connection with a merger, acquisition, financing, reorganization, or sale of assets; and internal reviewers or approvers who help manage access to the beta.

We require service providers to use personal information only for the services they perform for us and to protect it appropriately.

Data Retention

We keep personal information only as long as reasonably necessary to provide the service, manage accounts and access requests, maintain security, troubleshoot and improve the product, comply with legal obligations, resolve disputes, and enforce agreements.

Retention periods vary depending on the type of information and why we keep it. We may retain account and profile data while your account is active, delivery and message logs for operations and recordkeeping, consent and opt-out records as needed to honor communication preferences and comply with messaging laws, and backup copies for a limited period as part of ordinary systems.

When information is no longer needed, we may delete it, anonymize it, or retain it only in aggregated form.

Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. These may include access controls, authentication protections, encrypted transmission where appropriate, logging and monitoring, role-based access limitations, and vendor oversight.

No system is perfectly secure, and we cannot guarantee absolute security.

Your Choices

Depending on how you use Night Audit, you may be able to update account or briefing preferences, change delivery days or timing, change topic watches and custom keywords, opt out of SMS by replying STOP, ask for help by replying HELP, unsubscribe from optional email communications if offered, or request access, correction, or deletion of your information subject to legal and operational limits.

If you stop SMS messages, we may still send account-related emails or other service messages where permitted or necessary.

Privacy Rights

Depending on where you live, you may have rights under applicable privacy law to know what personal information we collect, use, and disclose; access your personal information; correct inaccurate personal information; request deletion of personal information; opt out of certain processing or sharing where applicable; or appeal a denied request where required by law.

Children

Night Audit is not directed to children and is not intended for use by children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will take reasonable steps to delete it.

Night Audit is a US-based service. We may store and process information in the United States and in other locations where our service providers operate. If you use Night Audit from outside the United States, you understand that your information may be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your location.

Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the Last Updated date and may provide additional notice where appropriate.
